General
I retain all rights to all commissioned artwork. You are purchasing usage rights, not ownership of the artwork itself. I may use the art for my own publications or portfolio, including process videos; if you want your artwork to be private or non-disclosed for a certain period, let me know beforehand.I reserve the right to refuse a commission for any reason.
Your commission will always be tagged as one on my publications.Under no circumstances my artworks and creations are to be used through AI training, reproduction or data collection as well as in any blockchain-related technology, including NFTs and cryptocurrency.
order
To order you must provide me with the following information:A clear description of your idea, including inspiration pictures or a moodboard (poses, color palette, character reference, PDFs, etc.), and the format you need to receive the artwork in (PNG, JPEG, GIF etc., dpi and canvas size, portrait or landscape) if you need a specific one.You must send this information in one request message to confirm the commission with me.
After payment, I’ll send two or more sketches for approval. The sketch will be sent within 3-4 days. In case of time constraints, the sketch will be extended to a maximum of 1 week; any revision requests can be made at that time.After confirmation, the artwork process can begin; you will be updated two to three times, during the coloring stages of the artwork. Please be upfront and clear about your request to avoid further revision fees.
payments
100% of all payments are made upfront. If a situation calls for a split payment (150€+), we must discuss it beforehand; 70% has to be paid upfront, and the other 30% will be paid before delivering the completed, unwatermarked artwork.Commissions initiated on VGen must be paid through the platform; otherwise, payments go through PayPal. All payments are made in EURO.You accept that work on the commission will not begin until payment has been received.If no transaction is made within a week of the invoice, it will be cancelled.
revisions
You have the right to 1 complete revision and 2 minor ones in the sketching/lineart phase, 2 minor edits in the coloring phase, and 1 minor edit after completion. Requests that exceed the number of free revisions will incur a revision fee of 20% of the initial price.I won’t be able to continue the revision until the additional payment has been received.There will be no major revisions after the completion of the artwork.To avoid needing such changes, please be clear in your request (order section).
deadlines & delivery
The beginning of the process will be as soon as possible, depending on the other commissions I’m potentially working on. I will make sure to complete the artwork in no more than 2 months after the payment.This deadline is set a bit longer from the time of payment in case of personal issues, emergencies or workload; in regular times, the commission will be delivered in 1 to 3 weeks (depending on the type of service).I ask you to not rush me or ask excessively for updates, I tend to send them myself.If you have a hard deadline, please mention it ahead of the beginning of the commission, to avoid confusion or late delivery. There are no rush fees, therefore you need to be clear about any potential deadlines.All artwork/product will be sent digitally to you through either email, Google Drive/WeTransfer or other similar platforms in the format you need.It is your responsibility to propose a delivery method which works for both parties.I can’t be held accountable for loss of access to the delivery method, loss of files/of the artwork(s). You must store your product properly, for I cannot guarantee the availability of the original copies.
usage rights
Personal use includes:
printing for yourself
using the art as profile pictures, wallpapers or banners online
sharing or reposting the artwork
sharing as a reference to your characters
and any other use that is non-monetized.
Commercial use for content creation includes:
digital marketing and advertising
online promotion
using as stream assets
distributing digital products to monetized platforms
and any other use for financial gain online.
Commercial use for merchandising includes:
everything from content creation use
printing, redistributing and reselling value-added digital and physical content for financial gain (reselling commissions ‘as-is’ is forbidden)
and any other use for financial gain online and/or physically.
You may not claim the artwork as your own, remove my watermark, trace or modify the commission, or associate it with hateful discourse.You may not use the artwork commercially without my consent or without purchasing the correct commercial license : +50% of the base price for content online, +100% to use for merchandise.Credit is not mandatory, but greatly appreciated :)
refunds & cancellations
You have right to request a full refund if there's been no progress or communication for 2 consecutive months, or when the commission has not been completed within 4 months. These provisions exclude work interruptions caused by unforeseen circumstances, such as illnesses or accidents.You have the right to request a full refund before the commission starts, and a partial refund of 80% of the price up until the sketch phase for any reason; after that, no refunds will be issued.I reserve every right to refuse or cancel any order, under condition of full refund, without the need for explicit reason.Any disrespectful behavior will not be tolerated and may result in a cancellation of the order.
You will not receive any refunds and I have full right to refuse you any service in the future, ending up in a blacklist. This blacklist may be shared with other artists or made public.Unresponsiveness will result in a cancellation; if there’s been no communication from you for 2 consecutive weeks, I will determine the commission as over. You may request a refund up to 50% of the initial price.
Communicaton
All communication goes through vGen or discord (@charmiella), and email ([email protected]).Both parties agree to communicate in a fast and responsive manner, responding swiftly to any requests for comments, clarifications, opinions, validation of progress, etc.
